The Constitution of Kenya, 2010 vests the ownership of natural resources including oil and gas in the National Government in trust for the people of Kenya. The national values and principles of governance, land and environment principles and principles of public finance are some of the principles employed in petroleum. The State Department for Petroleum in consultation with stakeholders is responsible for developing and implementing policies and laws esposusing applicable constitutional principles, best industry practice, among others. This is done with the objective of promoting sustainable development of the petroleum sector.

The following are the existing main policies and laws governing upstream, midstream and downstream petroleum in Kenya:

A National Petroleum Policy and regulations under the Petroleum Act are being developed.
